1. Description of Services: We offer MLS listings in Ohio, and sellers can sign up for various listing packages. The purpose of this website is to help our clients and customers access top-quality real estate services through a model which is an alternative to the traditional or “6%” model. We provide real estate services and education to all–some for a fee and some at no charge. If listing services are purchased, we generate a listing profile in one or more Ohio MLS systems, depending on the property location. All sellers must enter into a listing agreement with us. We may provide additional consulting services for pricing, offer negotiation/review, contingency troubleshooting, document review, transaction management, and other services which may or may not require an additional quoted upfront fee. We will never charge a fee that is not disclosed beforehand.
2. Payment Terms: All listing packages and optional products are paid for via online payment methods, including PayPal, Stripe, and debit/credit card processing. Fees are quoted upfront and must be paid at the outset of service commencement.
3. User Obligations: All real estate services requiring a license must pertain to Ohio real estate. Users must have the legal capacity to execute listing agreements, property disclosures, lead paint disclosures (if applicable), purchase agreements, and deeds for property transfer. Users must not list properties if they have an equitable interest or enter into an assignment purchase agreement intending to use our services to find another buyer before purchasing the property. Users may only assist true property owners without collecting fees. To collect a fee for assisting the seller requires an active real estate license in Ohio. All other products and services which do not require a license, whether physical or digital products are intended for their stated use.
4. Intellectual Property Rights: All materials on our website, including page content, graphics, photos/images, logos, slogans, quotes, blog content, videos, podcast episodes, free documents, checklists, scripts, templates, digital courses, and more, are copyrighted by Ohio Virtual Realty, LLC and LVR Real Estate, LLC. These materials must not be used for commercial purposes, copied, or distributed without written permission from the aforementioned companies. Any user wishing to reprint or otherwise use our material or concepts must contact us in writing prior to any use being granted.
5. Limitation of Liability: We provide our services without warranties or guarantees, and we shall not be held liable for damages arising from the use, misuse, lack of use, or any perceived service issues. We are not responsible for users’ inability to sell their properties or for data errors committed throughout the process. Our liability is strictly limited in all cases.
6. Testimonials and Client Information Usage: By providing a testimonial or agreeing to have their information used in marketing, clients grant Ohio Property Group, LLC (“we,” “us,” or “our”) the right to use their testimonials, names, photos, and related details for marketing purposes, including but not limited to our website (OhioMLSFlatFee.com) and social media platforms.
7. Release of Claims: Clients release Ohio Property Group, LLC and its affiliates from any claims or liabilities arising from the use of their testimonials, names, photos, and related details in marketing materials.
8. Right to Modify Testimonials: Ohio Property Group, LLC reserves the right to edit, modify, or remove testimonials for clarity, length, or consistency while maintaining the essence of the client’s feedback.
9. Responsibility for Accuracy: Clients are responsible for the accuracy of the information they provide in testimonials. Ohio Property Group, LLC is not responsible for verifying the accuracy of client-provided information.
10. Privacy and Data Usage: We do not sell user data. Our privacy policy governs the collection, use, and protection of user data and can be referenced or linked from our Privacy Policy.
11. Termination: Users may terminate their listing services at any time through written communication, including email or site update forms. We may terminate services at our sole discretion for violations of the Terms, listing agreement, purchase agreements, fair housing laws, MLS regulations, local, state, or federal laws, or for abusive conduct, which we will determine. Refunds, if issued, will be subject to a 5% processing fee and may take 1-10 business days to execute.
12. Dispute Resolution: Disputes will be resolved by ownership of the website company and will be governed by applicable local, state, and federal laws, including real estate law and MLS regulations.
13. Text messaging and SMS communication: From time to time prospects, customers, clients, partners, and vendors may contact us using SMS or text messaging. By checking this box and initiating SMS messaging with us, you agree to receive text messages at the number provided. Message frequency may vary. Standard message and data rates may apply.
